A Characteristic of International Civil Servants' Official Legal Relationship

Summary/Abstract: The article discusses types of employment contracts offered to international civil servants mainly through the analysis of the Law of Precedent interpreted by international administrative tribunals. Reference is also made to other sources of applicable law such as the general principles of law, staff regulations, internal administrative directives and the practices of international organizations. 1Ъе author argues that a Letter of Appointment supplies the legal basis for the terms of appointment and that it is an essential individual administrative act. A comparison is made between the probationary periods of international civil servants and national ones on the basis of Bulgarian administrative legislation. The stability of the official relationship enjoyed by international civil servants is considered as the basic principle of international civil service. The latter is complimented by employees' mobility. Conclusions in the article are made on the understanding that the international civil service is an independent institution within international public law which is based on a specific legal relationship between employer and employee.
