A HISTORICAL PERSPECTIVE ON ROMANIAN CONSTITUTIONAL AND ELECTORAL SYSTEM

Summary/Abstract: This study proposes an analysis of Romanian voting system, the mechanisms by which governments have tried to maximize electoral chances, through the constitutional regulations during 1858-1939, and accordingly, the three fundamental legal acts. The period mentioned aims modern Romania with its two forms of government: monarchy and republic, so we are talking about the royal constitutions: 1866, 1923 and 1938 and the Constitutions of the Republic - totalitarian initially, then after 1989, based on freedom and equality: 1948, 1952, 1965 and 1990. It should be noted that modern Romania knows three periods of constitutional vacuum: between 5th September 1940 and September 2nd 1944, and between 30th December 1947 and 13th of April 1948 and between 22nd December 1989 and 8th December 1991.
