Summary/Abstract: This article discusses the historical circumstances of the Balfour Declaration and its impact upon the legal framework under which the State of Israel came to existence. Furthermore, this article ventures into the legal development in the subsequent years of the existence of Israel, in particular in relation to the 1967 CE war, including the historic view upon the issue of the West Bank as terra nullius. In doing so institutions of public international law, such as definition of a people and the rights of self-determination are being discussed from a historizing point of view in which the progressive development of public international law in the 20th Century CE is being taken in consideration.
