NEW ISSUES IN STANDARDS OF INCIDENT COMPETENCE IN THE NEW CODE OF CIVIL PROCEDURE

Summary/Abstract: With the entry into force of the new Code of Civil Procedure, civil process was reconfigured and new texts sparks immediate interest to the legal world through the legislative consecration of jurisprudential solutions through enactment of new institutions or by changing fundamental institutions. In this context, including rules governing jurisdiction were readapted to the new requirements of the legal and incidents on the plea of lack of competence, connectedness, competence conflicts, displacement, identity of causes, bring new elements whose purpose is the creation of legal rules which serve particular interests, in order to capitalize on past experiences and employing future jurisprudence.
