Summary/Abstract: In this paper is analyzed in a different way the form and content of the dismissal decision, as a unilateral act issued by the employer, both for reasons of the employee and for reasons beyond the person. It specifies that this juridical act is an act concerning the labor law and it is not an act of administrative law. It was taken into account that in addition to the mandatory specifications set by Article 76 of the republished Labour Code,the dismissal decision must include other elements necessary for the content of the for compliance of the necessary legislation. Thus, it was considered the essential and mandatory elements: name,surname, office both of the employers and the employee, number and date of registration in the register of the decision of the employer for other reasons in law and in fact required to be stated thereof.
