Summary/Abstract: This research addresses the issue of the prohibition of dismissal of employee in maternity leave, dismissal stipulated by the provisions of the republished Labour Code, the provisions of Law No. 202/2002 concerning equal opportunities and treatment between women and men, and the provisions of Government Emergency Ordinance No 96/2003 regarding the protection of maternity at work.Distinct from the prohibitions stipulated in normative documents provided for in national law, has made a review of the ban laid down in accordance with European directive respectively the Directive no. 92/85/EC of 19th October 1992 concerning the introduction of measures aimed at improving workplace health promotion workers in the period from the beginning of pregnancy until the completion of maternity leave. It has made the relevant clarifications that shows that in the drafting of internal regulations, in the incident under review, the Romanian legislature has not made a faithful transposition of European norm actually requiring proposals of de lege ferenda.
