Summary/Abstract: Throughout history, criminal law constitutes a recognition that the society showed ongoing concern for the protection of its fundamental values, in the context of the existence in its ranks of the negative human factors able to undermine social harmony and good living. By ignoring the danger of such tendencies and without a response as effective against destructive social actions, the society would record, of course, a regress. However, in the actions and measures to combat crimes in a modern society, victim's rights should be respected, and also those of the aggressor.Psycho-sociological studies have shown that crimes involving sexual life committed by a family member were more traumatic than those committed by an unknown, which is why these facts have been criminalized and punished as. Whether passive subject has undergone only one abuse or repeated abuses, he must be protected from such degrading and violent acts that provokes lengthy and powerful psychological trauma and who endanger the physical health.
