Summary/Abstract: The current Criminal Code criminalizes in Chapter VIII in a new vision, crimes against sexual freedom and integrity, in a conception according to the different reglementations that are contained in European criminal codes, regarding protection of social relations in this category.Analyzing the legislative history of the occurrence of the crime of sexual harassment, we see that this offense was initially regarded as a discrimination on grounds of sex in the framework of labor relations."In European countries, in general, sexual harassment is defined as any unwanted conduct of sexual nature or any kind of behaviour based on sex, affecting the dignity of women and men in the workplace".
