Summary/Abstract: Recent provisions of the Civil Code of Romania entered into force on the 01.10.2011 are bringing out the availability of the Romanian law maker and his flexibility to adjust a general rule to specific features that complex reports between individuals can create in the patrimony social life. Same mentioned sensitivity is shown in the field of random contracts that we proposed to analise in a comparative study regarding annuity and maintenance contracts from legal features point of view without the claim to be exhaustive the issues generated in practise by the new law provisions that will certainly be amplified.
