Summary/Abstract: The consent of the assigned represents a condition imposed by the law so that the cession of the contract would operate from one of the initial contractors towards a third, which thus becomes a party of the contract. The present paper debates the judicial nature of the consent and the role it plays within the tripartite operation which defines the new judicial institution of contract assignment.
