THE TERMINATION AND RESCISSION OF CONTRACT – GENERAL ASPECTS

Summary/Abstract: The issue of contract termination and rescission has been a major preocupation throught the scientific judicial literature. We shall endeavour to carry forth the topmost legal angles provisioned for by the dispositions in the current Civil Code, while allowing for brief interludes into the past dispositions on this subject matter. The termination and the rescission of contracts, as two of the most important redress methods for the non-execution of the assumed contractual obligations, are especially consequential both from the theoretical and practical facet. Wherefore we shall as well advance the law court’s decisions on the subject matter.
