Summary/Abstract: In accordance with current statutory civil liability takes two main forms, namely tort and contractual liability. But any form of civil liability, obligation or compensation for damages caused occurs if the following conditions are met: damage, illegal act, fault, negligence and causation author of the act and the damage.The same conditions must be met when talking about tort liability of members of the management of companies in insolvency proceedings. However, given the special nature of this type of responsibility, must met another condition, namely the insolvency of the company.
