COMPARATIVE LAW ON NO. 85/2006 AND LAW NO. 85/2014 ON THE ATTRACTION OF LIABILITY FOR ENTERING THE DEBTOR IN THE INSOLVENCY.

Summary/Abstract: The new insolvency code, in effect from 28 June 2014 contains a number of provisions which are intended to ensure fluency insolvency proceedings. Thus, the new reglementation contains certain legislative news and answer to many of malfunctions frequently met in the application of the Law no. 85/2006 on insolvency proceedings. However, there are a number of issues raised by insolvency practitioners who remained, still without an answer from the legislature.However, Law no. 85/2014 on procedures to prevent insolvency and insolvency managed to create a balance between the interests of the debtor and its creditors, through the establishment of collective proceedings in order to cover the liabilities of the debtor, granting, when it’s possible, a chance of recovery activity.
