Summary/Abstract: The physical movement of employees in order to perform specific activities under an individual employment contract is no longer necessary in the sense of new trends. The development of new types of employment contracts allow work to be carried out remotely in specific coordinates of what is called teleworking or telework. Teleworking is a form of organizing and carrying out the work using information technologies under an employment contract, where the work could be carried out regularly and outside of premises of the employer, a variety of this type of work being the work home analyzed in this paper.Work at home is a flexible form of work which has gained increasingly more notoriety and to which the specific legal framework was adapted accordingly.Information technology enables teleworking using telecommunications, thus achieving a transfer of work to the worker/employee. Working from home is that work performed by a person at his/her home or in another place of his/her choosing, subject to remuneration from the employer in order to achieve a good or a service, given that the economic independence and autonomy owned by the one working at home is not reaching the threshold of an independent worker, as he/she is called in the national legislation.
