Summary/Abstract: The element of novelty that appears in the Criminal Code adopted by Law no. 286/2009 is that it has unified the regulations of the previous laws that were repealed and here we refer to the provisions of Law no. 39/2003 and Art. 323 of the Criminal Code previously included in Art. 367 of the Criminal Code in force. Even in the event the repeal of some legal provisions occurred it is undeniable that they have not been decriminalized as judged at a time by the legal practice, but on the contrary, the concepts regarding the initiation, establishment, adhesion or support are identical with the actions incriminated in the provisions of Art. 367 of the Criminal Code in force, fact which reaffirms the intention of the legislature to further take over and punish this criminal offence which constitutes a particularly serious phenomenon given that we are witnessing the expansion of the activity and incidence of crime groups that benefit from enormous competitive advantages and fraudulently prejudice the Romanian economy.
