Summary/Abstract: The principle of presumption of innocence represents the basis of the right to defence and of the other procedural rights which the law grants to the suspect or defendant, being a way in which the court can establish the guilt of the defendant beyond any reasonable doubt.However, a breach of the presumption of innocence may arise in the course of the criminal proceedings, either by a prosecutor, a judge, a court or a public authority, through their statements or their deeds concerning commission of an offense or anticipating the commission of an offense by a person, as well as guilt thereof.
