The properties of operation on the bordes between substantive and procedural law

Summary/Abstract: The author draws attention to the fact that some participants in acts of civil legal relations (action, the court settlement) stands on the border between substantive and procedural law. From this fact derive some of their specific characteristics that distinguish them from ordinary legal action. Jurisprudence that fact still does not pay sufficient attention. Therefore, the Czech courts in their interpretation make mistakes. The article deals with these incorrectness.
