Summary/Abstract: The main goal of the article is to analyze the foundations of discrimination against women in the labor market and to present the problem of institutional discrimination. Therefore, first the phenomenon of discrimination on the consumer and producer market under freemarket conditions was analyzed, and similar considerations were made in relation to the situation assuming state intervention. On this basis, it was explained that in both markets in a freemarket setting, we should expect to see no discrimination other than on the basis of price; in particular, there should be no discrimination on the basis of sex. In the case of institutional discrimination, however, an individual may be denied goods or employment only due to government regulations – that is, independently of the will of the seller or employer. This is a big problem for women in the labor market in particular, and it is usually overlooked in the literature.
