Several Remarks upon Proceedings in Front of the Voivodship Commission Adjudging in Cases of Medical Incidents, in View of Its Legal Status

Summary/Abstract: The present study focuses on the legal status of regional (voivodeship) adjudication boards for medical incidents and the proceedings before those boards. The status of anadjudication board has not been unambiguously specified by the legislature. The board doesnot exercise public authority, but its decisions are binding on the insurance institution and the healthcare entity. Adjudication board proceedings have a significant drawback, namelythe devolution principle is not applied and the adjudication activity of these boards does notreceive judicial supervision
