Summary/Abstract: In modern Romania, from a legal and canonical perspective, the Sacrament of Marriage can only be celebrated after the civil marriage took place. Therefore, if there are two celebrations, civil and religious, the first being mandatory for the reception of the second, there must exist two divorces, one bearing civil effects and one with ecclesial consequences. The civil divorce is recognized by the Church and the ecclesial divorce can only be pronounced after the civil one. However, the civil laws do not recognize the ecclesial divorce. The dissolution of marriage is an exclusive right of the bishop, similar to the right he has in granting dispensations for the administration of Sacraments in exceptional situations.
