NOŢIUNEA DE „FERMIER ACTIV” ŞI DOVEZI VERIFICABILE ÎN CONTEXTUL PLĂŢILOR DIRECTE ACORDATE PRIN SCHEME DE SPRIJIN ÎN CADRUL POLITICII AGRICOLE COMUNE
THE NOTION OF ACTIVE FARMER AND VERIFIABLE EVIDENCE IN THE CONTEXT OF DIRECT PAYMENTS GRANTED THROUGH SUPPORT SCHEMES UNDER THE COMMON AGRICULTURAL POLICY

Summary/Abstract: The redefinition of the status of active farmer starting with the year of application 2019 is also established by verifying the registration of the natural and legal persons and the associative forms of natural or legal persons, regardless of their legal status, for their agricultural activities, in the Register of taxpayers / payers, according to the provisions of art. 91 of Law no. 207/2015 regarding the Fiscal Procedure Code, with subsequent amendments and completions, in compliance with the provisions of art. 3 pc. 3 lit. (a) of Regulation (EU) 2017 / 2.393 of the European Parliament and of the Council of 13 December 2017 amending Regulations (EU) no. 1.305 / 2013 regarding the support for rural development granted by the European Agricultural Fund for rural development (EAFRD), (EU) no. 1.306 / 2013 regarding the financing, management and monitoring of the common agricultural policy, (EU) no. 1.307 / 2013 establishing rules on direct payments granted to farmers through support schemes under the common agricultural policy, (EU) no. 1.308 / 2013 establishing a common organization of the agricultural products markets and (EU) no. 652/2014 establishing provisions for the management of expenditures on the food chain, animal health and welfare, as well as plant health and plant reproduction material. At the same time, the review of the legislation envisaged the introduction of the phrase of the verifiable evidence in the case of farmers, these verifiable evidences representing in fact documents from which the total incomes and the incomes obtained from the agricultural and non-agricultural activities, established by subsequent acts, were more than needed this new vision.
