Summary/Abstract: In the torment of these very busy times, we find that at the shelter of the rules governing some of the fundamental human rights, such as to live freely and to evolve together, in well-being and in a stable, lean, predictable and trust-based legal environment, lures a danger that comes precisely from the positive law. Accordingly to the well trusted jurist M. Duţu, who, in one of his articles stated that this is a terrible danger manifested by the invasion of an unmet social legalism through an excessive, unstable and incomprehensible normal approach, through an increasingly compelling demand for compliance in the first period. All these elements distort the right and generate fear, insecurity and social instability and, in my view, represent the direct consequences of the indoctrination of the education of the masses, forcing the identity cultures of the nations towards a globalizing mega-culture Sui-Generis.
