Summary/Abstract: The scientific approach aims at arguing, on the one hand, the necessity of setting up in the Romanian law the system of the labor courts, courts specialized in solving individual labor conflicts, and, on the other hand, the need to reconfigure the legal status of the legal assistants, representatives of the parties towards working in court panels, by regulating their participation, both in the substantive and appeal proceedings, and by giving their vote deliberative value.The arguments in support of these legislative changes start from the history of the Romanian legislation in this field and continue with convincing aspects of the comparative law, as well as with the conclusions of a study conducted with the participation of some specialists in the field and undertaken with the help of methods of investigation that belong to the social domain.
