The Importance of International Recognition in the Process of the formation of state and legal subjectivity of Montenegro

Summary/Abstract: Recognition of the existence of state independence is a prerequisite for the development of state institutions necessary for a sovereign activity of a country in the international community. It is a process which implies a correlation between the historical course of a liberation struggle and the accomplished liberation from the rule of another country, accompanied by space created for the development of institutions of country’s own state organization. International recognition is, therefore, a mere prerequisite for acquiring the rights which other states, members of international community, have in all areas including the development of their own state institutions. This specifically means that the status of an international subject creates the necessary conditions for strengthening the capacity of a state, i.e. for the formation of state sovereignty of a country within the international community. The new state union thus becomes an equal partner in relations with other countries, while at the same time it gains the same equality in terms of possibilities for development of its own legal order. In this paper, the author has tried to follow the course of the process on the example of Montenegro on both levels, and in terms of development of institutions of authority accompanying the formation of the state subjectivity of the country.
