The Preventive Agreement - a Legal Solution in the Context of the Globalization and the Economic-Financial Crisis

Summary/Abstract: Globalization is a phenomenon with multiple cross-border valences. It is manifested in multiple plans of the economy, but its most dynamic segment is the financial one. Globalization shows us that another world is possible, but besides the great benefits that it brings to mankind, it can also generate negative phenomena such as economic and financial crises. Anti-crisis measures and their adjustment mechanisms are diversified and can have economic, political, and legal components. The preventive agreement is a legal solution applicable to financial crisis and not only. It is a contract that ends between the borrower in difficulty, on the one hand, and its creditors and which is approved by the syndic judge.
