Unlawful Labor and its Consequences

Summary/Abstract: The study aims to analyze the hypotheses that constitute undeclared work and the legal liability of the employer or, as the case may be, of the employee in the case of work in these situations. Through O.U.G. no. 53/2017 for amending and completing the Law no. 53/2003 - The Labor Code was introduced in the Code Art. 15 ind. 1, which conceptually stated the situations that constitute undeclared work. Correlative, art. 260 of the Code has been completed, establishing the sanctions applicable if the employer uses undeclared work or if a natural person does work without having concluded an individual contract of employment in written form.
