Summary/Abstract: We are interested in the frame of constitutional patriotism in the European Union. Certain authors strongly advocate for a reflexive transfer of this concept within the EU framework; we consider the same efforts plausible, but we are forced to see certain and structural difficulties on the same orientations. There are structural-contingent reasons: the EU genealogy, its legal and economic structure, and the post-crisis constellation create constitutional uncertainty. We do not reject the possibility of constitutional patriotism in the EU, but we want to think about the obstacles in a post-crisis situation that is provisional. In the first part, we consider the meanings of constitutional patriotism in the context of European tradition, and we particularly show the dynamics of these meanings within the context of the change of understanding of constitutive power. In the following section, we prove the difficulties of understanding constitutional patriotism in the European Union, especially considering: a) economic constitutionalisation, b) the influence of German ordoliberalism, c) crisis of technological guardianship in the European Union.
