Summary/Abstract: The Court again faced the preliminary references within which it had to establish whether the Public Ministry (Belgium) can be considered as "issuing judicial authority" of a European arrest warrant (EAW), within the meaning of art. 6 para. (1) of the Framework Decision 2002/584/JHA (2). In the Case C-626/19 PPU, the Court (First Chamber) states the following: The Council Framework Decision 2002/584/JHA of June 13, 2002 on the European Arrest Warrant and surrender procedures between the Member States, as amended by the Council Framework Decision 2009/299/JHA of 26 February 2009, must be interpreted as having the meaning that it does not oppose the legislation of a Member State which, given the power to issue a European arrest warrant for the purpose of executing a sentence to an authority which, although involved in the administration of the justice of that Member State, is not itself a court, it does not provide for a distinct judicial remedy against the decision of this authority to issue such a European arrest warrant. While the Case C-626/19 PPU concerns the EAW issued for the criminal prosecution, regarding the related cases C-566/19 PPU and C-626/19 PPU, the referring court relates to the EAW issued for the enforcement of a custodial sentence imposed by a final decision.
