On the problems related to the temporary detention of a city mayor

Summary/Abstract: The opinion refers to the issues relating to the expiry of the mandate of a commune head (city mayor) in a situation s/he is temporarily detained. It is pointed out that under such circumstances the mandate does not expire ex lege, but it is possible to recall the commune head on the basis of the provisions of the act on the commune government. If a forced administrator is appointed in a commune, it is possible to hold a local referendum on recalling the head of the commune
