Summary/Abstract: The issue of the creation and termination of the mandate of a member of the municipal council, ie the regulation of municipal elections as a whole, combines the principles of the right to vote and the principles associated with the right to self-government. Any legal regulation in this area must respect these principles given by the constitutional order and move strictly within the framework defined by these principles. Specifically, this means that the task of the legislator is to legally adjust the circumstances of the establishment and termination of the mandate of a member of the municipal council so as to give legitimacy to the mandate, ie the principle of time-limited government is preserved, the content of subjective suffrage was based on traditional principles and the municipality's right to self-government. After all, it is above all the way of gaining political power that legitimizes this power.
