Externalities of Constitucionalization of Legal Order

Summary/Abstract: The contribution notices some externalities of process of constitualisation of legal order. This process strengthens enforceability of fundamental rights because pressures ordinary courts to interpret rules in the light of constitutional principles however, on the other hand foreseeability of law and legal certainty becomes weaker by this way. Another consequence is the conflict of competences of ordinary justice and the constitutional court.
