The dynamics of interpretation and application of Article 46 of the Constitution

Summary/Abstract: A short time ago, in this magazine, J. Filip convincingly dealt with the criticism of the alleged "overcrowding" of the President of the Republic V. Havel by analyzing the calculation of the term defining the president's term of office. He also mentioned the effort to extend the scope of the Constitutional Court's judgment No. 30/1998 Coll., Which interprets the principles of counting time in Czech constitutional law, also to Article 46 para. 1 of the Constitution. After his court, however, the cited provision regulates a different period, a substantive period - for a decision, which is why the method of its calculation should be different.
