Summary/Abstract: This article aims to answer the question of whether current international law contains a customary norm that would establish a universal jurisdiction for the prosecution of perpetrators of war crimes, and whether this universal jurisdiction is permissive or obligatory? Permissive universal jurisdiction would only entitle individual states to prosecute the perpetrator of a war crime, regardless of the place of the perpetrator and the nationality of the perpetrator or victim, while mandatory universal jurisdiction would oblige states to prosecute the perpetrator. By war crimes in this article we mean only war crimes stricto sensu, ie serious violations of international humanitarian law, not war crimes lato sensu, as war crimes stricto sensu are sometimes collectively referred to as crimes against humanity and crimes against peace.
