Summary/Abstract: Originality is the legal criterion on the basis of which copyright protection is recognized. The legal construction of the originality of a work was drawn by writers in the second half of the XVIII century. Thus, a concept of romantic origin came to be transposed and systematized in the framework of law in the desire to legally paint a reality of the authors of original works. The current legal interpretation of originality is based on theories, which have been stated by writers. In this juridical-literary intertwining, we want to create the content of the article.
