Prerequisites (directives) for administrative sanctions imposed on a domestic insurance undertakings (part II)

Summary/Abstract: This publication is devoted to the analysis of normative directives, that are affecting the determination by the Polish Financial Supervision Authority of the administrative fines applicable to domestic insur- ance undertakings under the regime of the Act of 11 September 2015 on Insurance and Reinsurance Activity (consolidated text: Journal of Laws 2019, item 381, as amended). The aim of this study is to present how the indicated directives should be understood. The above is particularly important from the point of view of insurance undertakings, that are parties to the administrative proceedings conducted by the Polish Financial Supervision Authority. Proper understanding of the premises (di- rectives) of the administrative penalties implies appropriate behaviour of the insurance undertaking in the proceedings, which has a direct impact on the amount and ailment of the administrative penalty.
