Summary/Abstract: The creativity of artificial intelligence has led to the identification of DABUS as an inventor in two patent applications filed at the European Patent Office. As DABUS is an artificial intelligence-type invention programme, the European Patent Office has decided to refuse the patent applications. Relevant is the analysis of some arguments invoked by the applicant, which underscore the discussions about a modernization of the current normative framework. Thus, we aim at deliniating the real from the unreal from the perspective of an alleged inventor of artificial intelligence.
