Romanian National Legal Framework for Works on the Heritage Buildings

Summary/Abstract: The matter of the general legal framework of the works on the heritage buildings is not new to the Romanians, since they were subject to numerous actions of abuse and alteration, in time, particularly in the capital city. This has therefore led to a raise of general awareness, especially at the public authority level, regarding the imperious need to save these masterpieces by creating a legal framework able to ensure this much needed conservation. This paper thus envisages to offer a brief introduction in the analysis of the present main provisions on the conservation of heritage buildings, how they developed in time, accordingly with the risk of heritage destruction identified in reality and how all these amendments actually protect. Our study engages in analysing the legal provisions enacted in relation to the way construction works for heritage buildings are permitted, the focus being the intersection of the legislation on construction permits an d the one on the conservation of national heritage, without entering too much the field of what means heritage buildings and how should them be protected, but more how the actions taken by the Romanian state for safeguarding it affected the issuance of permits in this special cases.
