Summary/Abstract: The applicability of international humanitarian law rationae temporis can only be examined in the general context of its applicability in a correct interpretation of those provisions, particularly, given the nature of armed conflicts over the last decades. International humanitarian law has traditionally faced a constant issue: the lack of political will by the states to accept a broad interpretation of its applicability, which covers numerous forms of armed conflict from international and non-international armed conflicts to internationalized and transnational armed conflicts. However, the objective of international humanitarian law is well known: to ensure the possible minimum protection to the victims of armed conflict, regardless of their attributes, and in no way to ensure the interest of states to avoid its applicability under the pretext that one situation or another is not or cannot be covered by its rules.
