Summary/Abstract: This paper explores and analyzes the issues of migration of BiH citizens towards the countries of the European Union from the aspect of legislative analysis. Push factors are defined as factors of the existing legislative basis that have a direct cause-and-effect relationship with the external direction of migration. We see principal push factors as legal uncertainty, inefficient judiciary, non-compliance of legislation with international standards, and especially inefficient and ineffective executive. The main goal of the paper is reflected in the review and theoretical analysis of the legislation of the national labor legislation of BiH, with the recognition of legal shortcomings that hinder the process of preventive action to combat emigration from Bosnia and Herzegovina. As a result, the paper identified key regulations on labor in Bosnia and Herzegovina, which we compared with the regulations of European conventions and labor directives, that helped us to create policy recommendations for the legislature in order to improve the legislation and the current actual situation.
