Summary/Abstract: An attempt has been made in this study to answer the question whether the possibility to demand satisfaction out of joint property, granted in art. 41 of the Family and Guardianship Code to a creditor whose personal debtor is one of the spouses, causes that the other spouse becomes a debtor in the meaning of substantive law with the limitation of his liability to assets covered by community of property, or whether such a spouse’s obligation is only abolishing the execution out of joint property. This is, among others, about whether the creditor with an enforceable title against the debtor may – regardless of whether he has attempted to obtain an enforcement clause against the debtor’s spouse under art. 787 of the Code of Civil Procedure, which proved to be ineffective, or whether he has not even made such efforts at all – demand in an action against the debtor’s spouse the fulfillment of the benefit having referred to art.41 §1 of the Family and Guardianship Code. Author doesn’t approve the view that in this case a spouse’s obligation is only abolishing the execution out of joint property.
