The freedom to choose the lawyer for providing legal protection and the consumer protection

Summary/Abstract: The development of the insurance field influenced also the field of the judicial representation, and on this merits, the European laws classified this new field as well, establishing the principles for providing legal protection and the conditions of the agreements concluded between the insurance companies and individuals having as object the costs related to the judicial proceeding and other related legal costs. This article is intended to expose the main aspects of the regulation regarding the provision of the legal protection which is the subject matter of Title II, Chapter II, Section IV of the Directive 2009/138/EC of the European Parliament and of the Council of the European Union on the taking up and pursuit of the business of insurance and reinsurance and to examine the relevant case law of the Court of Justice of the European Union.
