Processing of personal data in case of merger and acquisitions of companies

Summary/Abstract: Personal data are economically and socially integrated with other assets that must be protected in order to guarantee the fundamental rights and freedoms provided by the Constitution. The dynamics of the companies involve firm decisions related to property rights, the correct application of tax rules, as well as the transfer of personal data in a climate that is constantly changing. In order to put an end to the uncertainties that arise before the reorganization of a legal entity, this article aims to address the main stages to be considered when a company decides to go through an economic acquisitions or merger, respecting the rights of individuals as well as the legitimate interests of the processor.
