The religious rights of pupils and students in the public education system

Summary/Abstract: In a comparative study, the author analyzes the relationship between the citizen and the civil/religious administration in terms of the norms related to the right to religious education, particularly the right to religious freedom and the teaching of religion in schools. Following an examination of the situation in a series of European countries – Denmark, France, Greece, Germany, Italy, Spain in terms of religious education in public schools, its content, of religious freedom and freedom of conscience in relation to the teaching of religion and the training of the cleric, he presents the whole picture of teaching religion in the public schools in the European Union. A special part is devoted to the norms of religious freedom in education in the Romanian law. In conclusion, the author finds that in many countries alternatives to public education are not competitive or inexistent, while the right to choose a religious education in school in harmony with one’s personal beliefs is often hard to enjoy.
