Summary/Abstract: This article treats general aspects of the notion of law, the notion of the state, the meaning of the term law, the appearance and substance of law, human society, the first laws, the notion of the state, the content and functions of the state, state institutions, the principle of separation and balance of state powers, the law-state relation. The state and the law are closely linked, support each other and condition each other. The state and the law appeared at the same time, for the same reasons, and can be explained much better together. The state creates law and paradoxically, law shapes the configuration and actions of the state. The formation of states and human societies did not happen by itself, but involved the intervention of intelligence and will, that is, the deliberate limitation of human freedom: a convention, Pufendorf said.
