Summary/Abstract: The paper examines the historical roots of the right of the defence in canon law suits. It first distinguishes the instrumental and intrinsic goal of the right of defence and then examines the key moments of the origin of the right of defence in both parts of the Bible, in the Old Testament and the New Testament, then in classical canon law and finally in modern codified canon law. Finally, it summarizes the results of several studies on the right of defence in the current Code of Canon Law, which have been written and published in Czech.
