Summary/Abstract: When law and institutions begin to serve ruthless politics, instead of civilizing and constraining it, one of the foundations of the post-war European order is destroyed: the belief that any political power must be limited and controlled by institutions independent of it, especially, the courts. This analysis emphasizes that the future of the rule of law in Poland means the necessity to conduct a discussion going beyond the institutional aspect of Polish democratic consolidation and focusing on good practice and building social legitimacy for the law and courts. In 2020, we must be aware that Poland in the Union is also an obligation towards the community that Poland is co-creating. The stakes of the gradual reclaiming of independent institutions is either continuing to be part of the European legal community –– the rules and principles of which we accepted voluntarily in 2004 and which were the dream and aspiration of entire generations of Poles after 1945 –– or a definitive Polexit.
