Legal regulation of financing of collective redress as a means of protection of entities taking part in collective court proceedings

Summary/Abstract: The paper deals with the financing of collective court proceedings and its role in the protection of entities taking part in collective court proceedings. Emphasis is placed in particular on the protection of consumers‘ rights as members of a group. Due to the spread of this issue, the article deals only with the issues of sufficient financial security of the plaintiff and the transparency of financing of collective court proceedings. The general introduction is then followed by an evaluation of the legal regulation of these matters in the proposal of the law on collective court proceedings. The article also refers to the legislation contained in Commission Recommendation of 11 June 2013 on common principles for injunctive and compensatory collective redress mechanisms in the Member States concerning violations of rights granted under Union Law (2013/396/EU) and in Directive of the European Parliament and of the Council on representative actions for the protection of the collective interests of consumers, and repealing Directive 2009/22/EC.
