Summary/Abstract: The commented judgement of the Constitutional Tribunal of 6 October 2004 (SK 42/02), concerns the problem of delimiting court powers in the field of the constitutional review of local law in Poland between the Constitutional Tribunal and administrative courts. In its judgement of 6 October 2004, the Constitutional Tribunal allowed the possibility of examining – questioned in a constitutional complained – the constitutionality of local legal acts, however, only those that were general-abstract and not general-specific (such as local special development plans). The author analyzes the position of the Constitutional Tribunal, making certain reservation.
