Historical Development of the Regulationon the Criminal Law Protection of the Citizens’ Political Rights under Bulgarian Criminal Law

Summary/Abstract: The protection of the political rights of citizens through criminal law is traditional of Bulgarian criminal law. There are differences in the scope of this protection in the separate historical stages of its development. Established after the Liberation, criminal law covers not only the protection of the electoral law as a fundamental political right, but also the protection of other political rights. Limitation occurs under the Criminal Code of 1951, the Criminal Code of 1956 and the Criminal Code of 1968 which provide such protection only to franchise. The trend towards subsequent expansion was resumed in 1990 through the inclusion of crimes against the normal exercise of the right of political association and freedom of assembly, rallies and demonstrations. And it is in the course of discussion on the new Penal Code that we will understand whether or not this system will change and what the direction of this change will be.
