Summary/Abstract: The idea of establishing this non-governmental organization, the Romanian Institute of Commercial Law, took shape based on the suggestions of a working group, gathered around the late Professor Stanciu D. Cărpenaru, to promote and rewrite a new Romanian Commercial Code, rewritten according to a modern and flexible architectural plan, adapted to the century in which we live, and adapted to the contemporary economic phenomenon and the type of psycho-social relations that are created around trade, characterized by continuity, risk-taking and permanent (re)construction of mutual trust between the participants in the exchange of goods and services. Although it is based in Bucharest, the Institute integrates university teachers from several faculties in the country, public or private. Also, along with the academic wing, the Institute brings together notorious practitioners of commercial law – lawyers, insolvency practitioners, notaries – as well as current or former judges of high courts in the country.
